Defense continues with Lodato

Defense asking if Lodato carried Lukasz down the stairs after finding Michelle’s body.

Now defense is referring to the crime scene tape outside the the Andrews home. Asking if once the crime scene tape is up, no one’s to go past the tape. She’s explaining a crime scene contamination log is kept of who goes in or out of the scene.

She is saying she didn’t handle the phone in a way to preserve fingerprints/wasn’t wearing gloves when she first entered the home.

So far, Lodato has been on the stand about forty minutes.

Defense now asking Lodato questions

Defense asking if she (Lodato) still lives in her home at Gateway (she does). Now he’s asking about a stone walkway that goes around the gates.

Now the defense is focusing on the median on Gateway Boulevard behind the Andrews home. (Lodato kind of describes it as about ten feet wide)

Now he’s asking about lighting at the entrance/exit gate and about lights in the front of each home. (There are no lights at the gate, but there are individual lights in front of each home.

The state is now entering into evidence images of Lukasz

Exhibit 8 – photo of Lukasz

Exhibit 9 – photo of Lukasz’ socks with blood on them

Exhibits 10 and 11 – one is the foot of the stairway inside the Andrews home, (10) the other is the landing of the Andrews home (at the second floor – 11).

Attorney asking if the light is on above the landing – yes it is.

Exhibit 25 – the Uniden phone – submitted into evidence. State is asking Lodato to open the sealed evidence bag containing the phone.

She’s putting on gloves now.

There’s another bag inside the bag, and she’s cutting it now. She took the phone out and held it up so the jury could see it.

Defense exhibits 31 and 32 entered into evidence. They’re photos of the bodies of Steven and Michelle. (31 is Steven 32 is Michelle)

Testimony of Tracie Lodato, cont’d

Prosecution is establishing Cypress Pointe is a gated community, which requires a code for entry. (Swing gate rather than arm gate).

Now they’ve put a sticky note on the Andrews home on the aerial photo.

Lodato (Gaydash) knew Steven and Michelle as acquaintances…neighbors.

Defense Exhibit 7 – photo of Steven and Michelle Andrews.

She parked in front of the mailbox and then knocked on the door.

She didn’t get a response, started to walk to the right but dispatch said go back to the door because when she knocked a child said mommy. She spoke to the boy and he opened the door. he had the phone in his hand.

She walked in and announced herself. She says she figured the parents were sleeping. He had his blanket with him.

She continued to announce herself, and said the boy was pointing upstairs and saying momma. And as she walked upstairs she banged on the wall and continued to announce himself.

She says the boy led her upstairs…continued to announce herself.

She said at the landing she saw a deceased foot. She called dispatch, grabbed the boy and exited the home.

The next officer arrived about 4 minutes later.

In order to search a residence, they have to make sure there’s 2-3 people for a two story house. They went back inside to clear it – to see if anyone needed help.

Gaydash asked a neighbor to take the boy.

Deputies searched the first floor, guns drawn, but found no one and nothing seemed to be disturbed.

They then moved upstairs. They found a deceased man and woman in the main bedroom. they saw “Lots of blood”

The deputies then left the house.

Gaydash (Lodato) lived on Eagle Point Circle, too. She had lived there three to four years. She was the first responder to the Andrews home.

Prosecution is placing “sticky notes” at the entrance gate to Cypress Pointe and the location of Gaydash’s former home,

State calls Tracie Lodato (Tracie Gaydash)

The state has called its first witness, Tracie Lodato, formerly Tracie Gaydash.

She is a school resource officer, assigned to Bonita Middle School.

(She found the bodies of Steven and Michelle just after 7 a.m. December 27, 2005)
