Prosecution calls Al Lukomski

He’s a neighbor of Michelle and Steven.

The witness is pointing out his home on the aerial picture of Gateway.

Says he had met the Andrews but didn’t know them well. He says his family spent Christmas 2005 in Kentucky. They arrived back in Fort Myers around 10:30 or 11 pm on December 26th.

When he arrived home he didn’t notice anything out of the ordinary. They arrived home and went to bed. He went into work around 6:30, 6:45 a.m. to go to work. (He also worked in the Gateway community).

He says as he was leaving the gate (he was waiting for the gate to open) he saw someone. Says the person was bundled up, it was a cool morning. He tried to see who it was, but the person didn’t look at him. He didn’t think it strange at the time.

Couldn’t see his face, but he wore a camo jacket, blue jeans and a backpack – a string type backpack. Small bag with strings that act as shoulder straps. Adds the jacket had a hood on.

Believes the person was between 5’10 and 6’1″.

The man was entering the community by the exit gate. Saw what appeared to be a goatee on the man.

He thought it was odd the man didn’t look at him or wave or anything. Says the man walked in the direction of the Andrews home.

He says he hadn’t seen the person in the community before.

He says he heard a lot of sirens, more than normal. Couldn’t tell what direction they were coming from.

He says his neighbor called him and said there was a murder-suicide and there was a lot of police activity in the neighborhood. He called his wife to make sure she was okay. She said she was going to go to the scene to see if she could help.

He then went home to check on his wife, but couldn’t drive there. So he went to the Potter’s and Lukasz was there.

He says the camoflouge jacket looks very similar to the one the man was wearing that morning.

Lukomski met with detectives a few days later. He looked at a photo lineup, but was unable to identify anyone.

Cooper is standing and the witness is asked if there’s anything inconsistent with the man he saw that morning. He says Cooper’s height and weight is consistent with the man he saw that morning.

Defense is cross examining the witness.

Says it was odd because the man didn’t even glance at the truck, just looked straight ahead as he walked by.

Says Christopher Stroka took his statement and showed him the photo lineup.

The defense is done.

Prosecution redirecting.

Says he never saw a yellow motorcycle in front of the Andrews home before.

Defense redirecting.

Defense asked if there was any vehicle associated with the man. (was he driving a car or a motorcycle or anything),
